Recent cases have highlighted differing legal responses to drug abuse. While some individuals struggling with substance use are sent to rehabilitation, others face prosecution and possible prison sentences. This has raised questions about what determines whether an individual goes to rehab or jail. For instance, in a case involving eight individuals linked to explicit content that surfaced on various social media platforms, the suspects were taken into custody. Preliminary findings also indicated that they had used narcotic drugs, including cannabis. According to the Rwanda Investigation Bureau (RIB), the group faces multiple charges, including public indecency, publication of pornographic images via a computer system, and acts related to the use of narcotic drugs or psychotropic substances. According to RIB, five individuals – Emelyne Kwizera, alias “Ishanga,” Pascaline Igihozo, Salha Uwineza, Shakira Uwase, and Belyse Uwase – were referred to the Huye Rehabilitation Centre. Meanwhile, three others – Sany Nelly Uwineza, Patrick Ishimwe, and Josue Babingwa – are being prosecuted for publishing pornographic material. Their case file was submitted to the National Public Prosecution Authority on January 22. Why different legal actions? RIB spokesperson Thierry Murangira explained the reasoning behind these distinct legal measures. “When it is a first-time offense involving drug use, an individual can be given a chance to reform, especially if there are mitigating factors, “he said. However, he clarified that individuals arrested for other crimes, with drug use discovered as part of their offenses, are prosecuted for all violations committed. In this particular case, he said that those sent to rehabilitation were found to have taken explicit photos but had no intent to distribute them. They were among the first to report the issue, which coincided with RIB’s ongoing investigation into the source of the leaked content. Their proactive cooperation positioned them as victims rather than perpetrators. Investigations also revealed that their actions were influenced by drug use, which played a role in their decision-making. Murangira emphasised that for first-time offenders under the influence of drugs, rehabilitation is often recommended as a path to reform. Effectiveness of rehabilitation centers Murangira highlighted the positive impact of rehabilitation centers, stating that many individuals who have undergone the process have successfully reintegrated into society, returned to school, or resumed their careers. These centers aim to help offenders recover and prevent repeat offenses. However, he stressed that being sent to a rehabilitation center does not mean a case is closed. “Rehabilitation is simply an opportunity for an individual to reform and recover from drug use. If they repeat the offense, it is treated as a repeat crime, and prosecution follows, “he said.
