Actor Ndimbati acquitted

The Nyarugenge Intermediate Court has acquitted actor Jean Bosco Uwihoreye, alias Ndimbati, of the charges of defilement and intoxication of a minor.

While delivering the ruling, which took place on September 29, the presiding judge said that the court decided to clear Uwihoreye because the prosecutors failed to present undoubtedly evidence to pin him on both charges.

For instance, he mentioned that the prosecution failed to prove the date on which the girl was born to show that she was a minor, and also failed to show the exact date when the two sired their kids.

"Prosecution said it was December 24, 2019, while Uwihoreye said it was January 2, 2020,” he said.

Furthermore, on the charge of intoxication of a minor, the court ruled that he can't be convicted of such when there is no evidence to confirm that the girl was a minor.

Meanwhile, the court also ruled that Uwihoreye will not pay Rwf30 million of damages arguing that since there is no case, there is no damage.

Previously prosecution had requested to convict Uwihoreye and hand him a sentence of 25 years in jail.

During the hearing which took place on September 13, the prosecution said that Ndimbati defiled the girl after luring her with prospects of supporting her to start a career in the film industry.

The act resulted in the girl conceiving and later giving birth to a set of twins.

Prosecutors had said that there is documented evidence to show that the victim was a minor by the time the alleged crime was committed among others.

However, from pre-trial until the trial in substance, Uwihoreye denied all charges arguing that what was presented by the prosecution as evidence was lies fabricated by people who want to tarnish his name.

Uwihoreye added that the girl was not a minor by the time he sired the children with her, saying that documents presented to court showing her age were forged adding that on the said night (December 24) he was not in Kigali among others.

Uwihoreye has been detained since March 10 this year.
